Subject: Notice of Increase for Agriculture Reimbursable Overtime

The purpose of this Trade Notice is to inform the trade community of the implementation of a fee increase for reimbursable overtime services performed by CBP Agriculture Specialists to expedite the movement of agriculture commodities at ports of entry. Agriculture reimbursable overtime is authorized at ports of entry when specifically requested by entities, importers, and brokers requiring the services for the inspections, supervised performance of prescribed remedial actions, and/or safeguarding of agriculture commodities being imported into the U.S.

CBP has been authorized to charge for full cost recovery for services as per final rule published October 2, 2015 in the Federal Register Volume 80, Number 191 (Docket No. APHIS-20090047) — Fee Increases for Overtime Services. Effective November 2, 2015, and until further notice, billing associated with reimbursable overtime services will be calculated by the Office of Administration, Financial Operations, Debt Management Branch based on the amount paid to the CBP Agriculture Specialist for performing the service(s), and not at the previous proscribed rates.

Any requests for agriculture reimbursable overtime should continue being made in accordance with established port policies. CBP will require reimbursable overtime payment in accordance with existing regulations.
